GENERAL INFORMATION AND DISCLOSURE STATEMENT UNDER THE PERSONAL DATA PROTECTION LAW
This information and disclosure text has been prepared by Ada Dental Clinics within the scope of the Law on the Protection of Personal Data No. 6698, which was adopted on 24/3/2016, and relevant legislation, in order to inform and enlighten data subjects during the lawful collection, acquisition, storage, sharing, and protection of personal data. In this context, this information text is presented for your review in order to fulfill our obligation to inform in accordance with Article 10 of the relevant law regarding the conditions and purposes of data processing described below.
Definition of Data Controller: As defined in Article 3 of Law No. 6698, a data controller is “the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.” In this context, Ada Dental Clinics acts as the Data Controller in the processing of personal data and fulfills its obligation to inform through this disclosure text.
Legal Basis and Reasons for the Processing of Personal Data: In the event that personal data, as explicitly defined in the Personal Data Protection Law No. 6698, is obtained, it is processed in accordance with Articles 5 and 6 of the same Law. In this context, your personal data will be processed based on the legal reasons listed below, and your explicit consent will be requested for any processing beyond these legal grounds.
According to the Law, these legal grounds are:
- To be able to provide information upon request of authorized public institutions and organizations, especially courts and public officials,
- To fulfill legal obligations and to exercise rights arising from applicable legislation,
- To fulfill obligations arising from the processes of establishing, executing, or terminating a contract,
- Where processing of personal data by our organization is necessary for the establishment, exercise, or protection of rights of our organization, yourself, or third parties,
- Provided that fundamental rights and freedoms of the person are not harmed, processing is necessary for the legitimate interests of our organization (e.g., conducting satisfaction evaluations of existing customers, managing events and organizations, performing financial-accounting operations, carrying out audit processes, ensuring occupational health and safety, fulfilling notification obligations to competent public authorities such as courts),
- When it is necessary to protect the life or physical integrity of the data subject or another person who is unable to express consent due to actual impossibility or whose consent is not legally valid,
- When the personal data in question has already been made public by the data subject,
- When processing is necessary for the establishment, exercise, or defense of a legal claim.
Collection of Personal Data, Purpose of Processing The personal data obtained by us through our website or other methods mentioned above will be processed for the following purposes, depending on the nature of your personal data:
As Ada Dental Clinics, we will carry out necessary planning, evaluation, and work by our business units to benefit our customers from the products and services we offer;
Conducting advertising and marketing activities related to the services we provide and informing customers about similar issues, as well as conducting corporate communication activities;
Carrying out marketing and customer relationship management activities; organizing corporate communication and, in this context, other events, campaigns, and invitations, and providing information about them, conducting market research activities.
Improving and personalizing the digital platforms we provide for our customers, and if necessary, using cookies for this purpose;
Tracking, evaluating, customer management, and planning related to requests, suggestions, and complaints from relevant persons, and conducting evaluation studies in all areas;
Ensuring the sustainability of all activities carried out under Ada Dental Clinics, making improvements, and auditing the individuals and companies with whom we establish contractual relationships;
Ensuring the legal and commercial security of individuals in the business-service relationship within Ada Dental Clinics, Planning and executing occupational health and safety processes;
Using the aforementioned information to exercise legal rights, and using transaction history information as evidence in case of disputes after the termination of the legal relationship with the relevant person/institution;
Conducting planning, reporting, visitor/customer statistics, and similar examinations, and/or ensuring compliance with domestic regulations, providing the information requested by public institutions and organizations, and fulfilling reporting obligations.
Verifying the identity of individuals who perform transactions through the website/mobile applications or on behalf of someone, and recording the necessary address and other required information for communication;
Ensuring the security of the website and other electronic systems and physical environments established by Ada Dental Clinics
Rights of the Data Subject The rights of individuals whose personal data is processed, as stated in Article 11 of the Personal Data Protection Law (KVKK), are as follows:
- Learn whether personal data is processed,
- If personal data has been processed, request information about it,
- Learn the purpose of processing personal data and whether it is used in accordance with its purpose,
- Know the third parties to whom personal data has been transferred, domestically or internationally,
- If personal data has been processed incompletely or incorrectly, request its correction and request that the correction be communicated to the third parties to whom the personal data has been transferred,
- Even if personal data has been processed in accordance with KVKK and other relevant laws, if the reasons for processing it no longer exist, request the deletion or destruction of personal data and request that the deletion/destruction be communicated to the third parties to whom the personal data has been transferred,
- Object to a result being produced against the person solely through automated systems that analyze the data processed,
- If the person suffers damage due to the unlawful processing of personal data, request the compensation of the damage.
In order to exercise the above-mentioned rights, the written request with distinctive identification/registration information, the right to be used, and explanations regarding the request should be sent by registered mail to the central address of Ada Dental Clinics, "İstiklal Mahallesi Şehit Mehmet Karabaşoğlu Caddesi, No.67, İstiklal, Kazımpaşa Yolu Üzeri, 54050 Serdivan/Sakarya" in accordance with Article 11 of the Personal Data Protection Law (KVKK).
Evaluation of Data Subject's Requests According to Article 13, Paragraph 1 of the Personal Data Protection Law (KVKK), requests made regarding the exercise of the rights listed above, once sent to our region in writing or through other methods determined by the Personal Data Protection Authority, will be concluded as soon as possible, free of charge (However, if the process requires an additional cost, the fee determined by the Authority may be charged). We will respond to your request using the contact information you provided.
